Against the backdrop of increased white collar enforcement and cross-border investigations, our Guide to Canadian White Collar Defence and Investigations provides insights for those managing possible exposure to white collar regulatory or litigation proceedings in Canada.
In addition to a broad overview of the principal regulators that may be engaged in investigating and prosecuting white collar matters in Canada, the guide offers best practices and strategies to mitigate risk in this rising area of enforcement.
Watch Lisa Talbot, John Fabello and Rebecca Wise discuss the legal landscape of the guide, as well as how to address risk and mitigate exposure.
John Fabello (00:05): Hello, I'm John Fabello, I'm here with my colleagues Lisa Talbot and Rebecca Wise. We're very excited to announce the release of our new guide to Canadian White Collar Defence and Investigations. The guide is designed to give clients and practitioners from outside of Canada a clear understanding of the Canadian legal landscape in this area.
Lisa Talbot (00:25): Canada has seen a significant shift in the white collar enforcement landscape in recent years. One major trend is the rise in whistleblower legislation. Regulators are increasingly focused on encouraging whistleblowing and protecting whistleblowers, and that has really led to more internal and external investigations here in Canada.
Rebecca Wise (00:43): That's right Lisa, we're also seeing heightened regulatory enforcement activity, including the introduction of specialized bodies like the Ontario Serious Fraud Office. These changes signal a commitment to tackling complex white collar crimes with more resources and expertise than before.
John Fabello (00:59): Indeed, and cross-border cooperation between regulators and law enforcement has also become a critical factor in white collar investigations. Canadian and U.S. authorities, in particular, are working more closely together, which makes understanding Canada's regulatory framework essential for U.S. and international clients and practitioners who are managing these multi-pronged and multi-jurisdictional investigations.
Lisa Talbot (01:24): Our guide provides a practical overview of how Canada's regulatory system works, including the principal Canadian regulators and their key powers, common issues with Canadian white collar investigations and proceedings, and strategies to mitigate exposure.
Rebecca Wise (01:39): That's right. So, whether you're dealing with whistleblower reports, regulatory inquiries, cross-border investigations or litigation. This guide is an essential resource for managing the complexities of Canada's enforcement environment.
John Fabello (01:51): We're proud and excited to be sharing this guide with you to help bridge the gap between international and Canadian approaches to white collar defence and investigations.
