Food and Drug

Our award-winning, cross-border team helps clients grow their businesses and navigate the complex issues affecting pharmaceuticals, medical devices and diagnostics, nutritional products, food and beverage products, and other consumer products.

Overview

We counsel clients across every stage of the product life cycle—from the regulation, guidelines and policies affecting research, to clinical trials, marketing authorization, and product approval, and throughout post-approval compliance, pricing, marketing and advertising, transactions, and dispute resolution.

Our long-standing history in the food and drug industry allows us to offer market-leading insights into the complexities of this highly regulated area and work closely with clients to design and execute tailored strategies to support commercialization. This deep understanding of the sector allows us to provide strategic direction and best practices under federal and provincial regimes, including Health Canada, the Canadian Food Inspection Agency (CFIA) or Agriculture and Agri-Food Canada. We routinely advise on regulatory submissions, including those that have been rejected or stalled, and in negotiations with relevant authorities. We take a holistic approach to the marketing of regulated products and provide support for advertising and promotional initiatives, market access and reimbursement, regulatory audits, facility licensing, antitrust, governance, and negotiations with suppliers and retailers. We advise on urgent issues relating to recalls and product corrections, and their impact on product liability. When disputes arise, we represent clients in judicial reviews before provincial, federal and appellate courts or in litigation with competitors.
